Terms of Service

These Terms of Service ("Terms") govern your access to and use of LabTracks, a science inventory management system operated by LearnSight Systems ("we," "us," or "our"). By creating an account, you agree to these Terms.

1. Who Can Use LabTracks

LabTracks is designed for use by K-12 school staff, including teachers, lab aides, department heads, and school administrators. By creating an account, you represent that you are using LabTracks for professional educational purposes on behalf of your school or district.

You must be 18 years of age or older to create an account. LabTracks is not directed at students. If you are a school administrator granting access to staff, you are responsible for ensuring all invited users understand and comply with these Terms.

2. Your Account

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at hello@lab-tracks.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from unauthorized use of your account.

The person who creates a school account becomes the School Admin and is responsible for managing user access, including inviting and removing staff members.

3. Subscriptions & Billing

LabTracks Cloud is offered on an annual subscription basis. Pricing is as follows:

• Free - Desktop app only, 1 user, up to 300 containers, offline use
• Department Plan - $30/year, cloud access for one department (Chemistry, Biology, or Physics), unlimited users
• School Plan - $40/year, cloud access for all science departments, unlimited users, separate budgets

All new cloud subscriptions include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time before the trial ends without being charged.

Payments are processed securely by Stripe. We do not store your credit card information. By subscribing, you authorize us to charge your payment method on an annual basis until you cancel.

Subscriptions auto-renew annually. You can cancel or manage your subscription at any time from Settings > Billing within the app.

4. Acceptable Use

You agree to use LabTracks only for its intended purpose: managing school science department inventory. You agree not to:

• Use LabTracks for any unlawful purpose
• Attempt to access other schools' data
• Reverse engineer, decompile, or attempt to extract the source code of LabTracks
• Use automated tools to scrape, crawl, or overload our systems
• Share your account credentials with people outside your school

5. Data & Inventory Content

You retain ownership of the inventory data you enter into LabTracks. We do not claim any rights to your school's chemical or biology inventory data, purchase orders, or audit records.

You are responsible for the accuracy of the data you enter. LabTracks is an organizational tool - it does not replace compliance with applicable safety regulations, OSHA requirements, or your school district's chemical management policies.

6. Availability & Uptime

We aim to keep LabTracks available and functional, but we do not guarantee uninterrupted service. We may perform maintenance, updates, or experience downtime outside our control. We are not liable for any losses resulting from service interruptions.

The LabTracks Desktop app (Windows .exe) is available offline and is not affected by cloud service availability.

7. Termination

You may cancel your account at any time from Settings > Billing. Upon cancellation, your subscription ends at the close of the current billing period and your data remains accessible until then.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used for purposes inconsistent with LabTracks' intended educational use.

8. Disclaimer of Warranties

LabTracks is provided "as is" without warranties of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. Your use of LabTracks is at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, LearnSight Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of LabTracks, including but not limited to loss of data, loss of revenue, or any safety incidents related to chemical inventory management.

Our total liability to you for any claims arising from your use of LabTracks shall not exceed the amount you paid us in the 12 months prior to the claim.

10. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email (sent to the address on your account) or by posting a notice in the app at least 14 days before the changes take effect. Continued use of LabTracks after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Texas.
